1. Acceptance of Terms

Welcome to Purifyt. These Terms of Service ("Terms") govern your access to and use of the Purifyt mobile application ("App") and related services (collectively, the "Service") provided by Purifyt ("we," "us," or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

Age Requirement: You must be at least 13 years old to use this Service. By using the App, you represent that you are at least 13 years of age. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

2. Description of Service

Purifyt is a wellness application designed to help users track and improve their physical and spiritual well-being. The Service includes:

  • Fitness Tracking: Workout logging, exercise tracking, cardio sessions with GPS routes, personal records, and progress photos
  • Nutrition Tracking: Meal logging, calorie and macronutrient tracking, AI-powered food image analysis, and barcode scanning
  • Islamic Features: Prayer time calculations, prayer tracking, Quran reading progress, dhikr counting, and Qibla direction
  • Menstruation Tracking: Optional period tracking and cycle predictions
  • Social Features: Friend connections, activity sharing, leaderboards, and group challenges
  • Gamification: XP points, levels, achievements, and streaks

Some features may require a paid subscription (Purifyt Pro) to access.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Not share your account with others or allow others to access your account
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Subscription and Payments

Free and Premium Tiers

The Service offers both free features and a premium subscription ("Purifyt Pro") with additional functionality.

Billing

  • Purifyt Pro subscriptions are billed through the Apple App Store (iOS) or Google Play Store (Android)
  • Payment is charged to your App Store or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period

Cancellation

  • You may cancel your subscription at any time through your App Store or Google Play account settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds are provided for partial subscription periods

Refunds

All refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following the date of the price change. We will provide you with reasonable notice of any price changes.

5. User Content and Data

Your Content

You retain ownership of all data, content, and information you submit to the Service ("User Content"), including workout logs, meal entries, photos, and personal information.

License to Us

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service. This license ends when you delete your User Content or account.

Content Accuracy

You are solely responsible for the accuracy of your User Content. We do not verify the accuracy of user-submitted information.

Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, abuse, threaten, or intimidate other users
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated means (bots, scrapers, etc.) to access the Service
  • Circumvent any security features or access restrictions
  • Share your account credentials with others
  • Create multiple accounts for deceptive purposes
  • Use the Service for any commercial purpose without our written consent
  • Interfere with or disrupt the Service or servers connected to the Service

Violation of this policy may result in immediate termination of your account.

7. Health and Fitness Disclaimer

IMPORTANT: THE SERVICE IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR HEALTH CONDITION.

  • The Service provides general wellness and fitness information for educational and informational purposes only
  • Information provided by the Service, including nutritional estimates, workout suggestions, and calorie calculations, are approximations and should not be relied upon as medical advice
  • Always consult with a qualified healthcare provider before beginning any diet, exercise program, or fitness regimen
  • If you experience pain, discomfort, or any adverse symptoms during exercise, stop immediately and seek medical attention
  • The Service is not a substitute for professional medical advice, diagnosis, or treatment
  • We are not responsible for any health problems that may result from your use of the Service or reliance on information provided
  • AI-generated nutritional estimates may contain errors and should be verified independently

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU ARE PARTICIPATING IN PHYSICAL ACTIVITIES AT YOUR OWN RISK.

8. Religious Content Disclaimer

The Service includes Islamic features such as prayer times, Qibla direction, and Quran reading tools. Please note:

  • Prayer times are calculated mathematically based on your geographic location and selected calculation method. Times are estimates and may differ from your local mosque's schedule
  • Qibla direction is determined using compass and GPS data, which may be affected by device accuracy and local magnetic interference
  • We are not a religious authority. The Service does not provide religious rulings (fatwas) or spiritual guidance
  • For religious questions or rulings, please consult qualified Islamic scholars in your community
  • Content related to Islamic practices is provided for informational and convenience purposes only
  • We make no claims regarding the religious validity or accuracy of any calculations or content

9. Third-Party Services

The Service integrates with and may contain links to third-party services, including:

  • Apple HealthKit and Google Health Connect
  • OpenAI (for food image analysis)
  • RevenueCat (for subscription management)
  • Firebase (for notifications)
  • Open Food Facts (for nutritional data)

We are not responsible for the content, privacy practices, or terms of third-party services. Your use of third-party services is governed by their respective terms and policies. Links to third-party websites do not constitute endorsement.

10. Intellectual Property

Our Rights

The Service, including its design, features, content, logos, and trademarks, is owned by Purifyt and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the Service or any part thereof
  • Use our trademarks, logos, or branding without written permission
  • Remove any copyright or proprietary notices from the Service

Open Source

The Service may include open source software components, which are subject to their respective licenses.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without compensation or attribution.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that:

  • The Service will meet your requirements
  • The Service will be available at all times
  • Results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected

We may modify, suspend, or discontinue any part of the Service at any time without notice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL
  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED POUNDS (£100), WHICHEVER IS GREATER
  • WE SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM:
    • Your use or inability to use the Service
    • Unauthorized access to your data
    • Statements or conduct of third parties
    • Any other matter relating to the Service

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Purifyt, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

We reserve the right to assume exclusive defence and control of any matter subject to indemnification by you.

14. Dispute Resolution and Arbitration

Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at support@purifyt.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, you and Purifyt agree that any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the London Court of International Arbitration (LCIA) under its rules then in effect.

  • The arbitration shall be conducted in London, United Kingdom
  • The arbitration shall be conducted in English
  • The arbitrator's decision shall be final and binding
  • Judgment on the arbitration award may be entered in any court of competent jurisdiction

Class Action Waiver

YOU AND PURIFYT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Exceptions

Notwithstanding the above:

  • Either party may bring an individual action in small claims court for disputes within that court's jurisdiction
  • Either party may seek injunctive relief in court for intellectual property infringement

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

15. Termination

Termination by Us

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including if we believe you have violated these Terms.

Termination by You

You may delete your account at any time through the App settings. Account deletion includes a 30-day grace period during which you may cancel the deletion and restore your account. After the grace period, your data will be permanently deleted in accordance with our Privacy Policy.

Effect of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your User Content
  • Provisions that by their nature should survive termination will survive, including: disclaimers, limitation of liability, indemnification, arbitration, and intellectual property provisions

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of these Terms
  • Notify you through the App or via email
  • Post the revised Terms on our website

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Service.

17. General Provisions

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Purifyt regarding the Service and supersede all prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
